Terms of Service

These Terms of Service ("Terms") govern your use of Battery Passport Check at batterypassportcheck.com and your purchase of the report we provide — a screening of your batteries against the EU Batteries Regulation. By using this site or buying a report, you agree to these Terms.

1. What you are buying

Battery Passport Check sells a one-time position report. Pricing is shown at checkout and varies by region (from €99; the exact price for your location is displayed before you pay). The report screens the batteries you describe against Regulation (EU) 2023/1542 and presents which need a battery passport, whether you are the responsible economic operator, and which obligations already apply — based entirely on the details you supply.

2. The report is a screening, not legal advice and not a conformity assessment

The report is provided for general informational purposes only. It is a screening of your answers against the regulation — it is not, and must not be relied on as, legal, regulatory, compliance, engineering, or professional advice, and it is not a conformity assessment. It does not create any lawyer-client or other professional relationship, it does not carry out or replace the conformity-assessment procedures the regulation may require, and it does not produce the completed battery passport data record you are responsible for publishing. It is not a substitute for advice from qualified counsel or a notified body reviewing your specific situation. You are solely responsible for any decision you make, and you should consult an appropriately qualified professional before acting on anything in the report.

3. A moving target, honestly stated

The battery passport's exact data fields, access rules, and identifier standard are still being finalised through a delegated act (due 18 August 2026) and standardisation work. The report states its position as at its date and flags what is still pending. It is a plan based on the regulation as it stands, not a guarantee of the final technical specification. You should re-verify anything time-sensitive against the current text before you rely on it.

4. No warranty

The report and this site are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We draw on the regulation and public guidance that may be amended, superseded, or clarified over time, and we do not warrant that the report is accurate, complete, current, or fit for any particular purpose.

5. Limitation of liability

To the maximum extent permitted by law, Battery Passport Check, its operators, and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the site or the report. To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or related to the report or these Terms will not exceed the amount you actually paid for the report.

6. Refunds

Because the report is a digital product delivered on completion, refunds are provided for delivery failure — for example, if you paid but did not receive your report, or it could not be generated from the details you supplied. If your report failed to arrive or cannot be produced, email [email protected] and we will re-deliver it or refund your purchase. If you believe a specific determination in your report is wrong, contact us — we will investigate and, where a delivery or generation fault is on our side, make it right.

7. Acceptable use

You agree not to: resell, republish, or redistribute the report as your own product; scrape, bulk-download, or systematically extract content from the site; attempt to disrupt, overload, or gain unauthorised access to the site or its infrastructure; or use the site or report for any unlawful purpose. The report is licensed to you for your own internal business use.

8. Intellectual property

The site, its design, its text, and the report format are owned by Battery Passport Check and protected by intellectual-property laws. The underlying regulation and public guidance referenced in the report belong to their respective sources. We grant you a limited, non-exclusive, non-transferable licence to use the report you purchase for your own purposes.

9. Third-party services

Payments are processed by Stripe under Stripe's terms. Analytics are provided by Fathom Analytics. We are not responsible for the practices of third-party services, though we choose them with your privacy in mind (see our Privacy Policy).

10. Governing law

These Terms are governed by the laws of the United States and, to the extent applicable, the state in which the operator of Battery Passport Check is established, without regard to conflict-of-laws rules. You agree that any dispute will be brought in the courts located there.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the site after changes take effect constitutes acceptance of the revised Terms.
